Equipt (“we,” “us,” or “our”) respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our websites, marketplaces, and related services (collectively, the “Platform”). By accessing or using the Platform, you agree to the terms of this Privacy Policy. If you do not agree, please discontinue use of the Platform immediately.

We offer two core services:

1. Equipt (Marketplace) -A lead-generation platform where Buyers connect with Sellers who list equipment.
2. Equipt Pro (Software) -A SaaS solution (CRM, lead management, quoting, email marketing, and CMS) that Sellers, Brokers, and OEMs use to manage their businesses.

This Privacy Policy addresses both in separate sections to clarify the data practices for each service.

1. Scope of this Privacy Policy

   This Privacy Policy applies to information we collect:

   1. Through our primary website and any associated subdomains.
   2. Through our Equipt Marketplace where Buyers, Freemium Sellers, and Pro Sellers interact.
   3. Through our Equipt Pro software (SaaS platform) when Sellers manage leads, CRM data, and equipment listings.
   4. In email, text, and other electronic messages between you and the Platform.

   This Privacy Policy does not apply to information collected by third parties, including websites or services not operated or controlled by us (even if linked to/from our Platform).

2. Definitions

   1. “Buyer”:Any user who browses or requests information about equipment listings on the Equipt Marketplace.
   2. “Freemium Seller”:Any user who lists equipment on the Equipt Marketplace under a free or limited listing plan.
   3. “Pro Seller”:Any user who subscribes to Equipt Pro or a paid subscription plan to list equipment and utilize additional Platform features.
   4. “Personal Information”:Information that can identify you (e.g., name, email address, phone number).
   5. “Equipment”:Any item listed for sale or requested for purchase on the Equipt Marketplace.

3. Information We Collect

   We may collect the following categories of information:

   1. Personal Information

      1. Name, email address, phone number, company name, and physical address (if provided).
      2. Login credentials for your account on the Platform.
      3. Any information you submit when filling out forms, requesting information about listings, scheduling demos, or otherwise communicating with us.

   2. Usage Data and Device Information

      1. IP address, browser type, operating system, referring URLs, pages viewed, access times, and navigation paths.
      2. The length of time spent on pages, and any page interaction data.

   3. CRM/Lead Data (Primarily for Sellers Using Equipt Pro)

      1. Contacts, leads, quotes, and other CRM data a Seller may upload or store within Equipt Pro.

   4. Aggregated Data

      1. De-identified, aggregated data that does not personally identify you, used for analytics or improving the Platform.

4. Equipt (Marketplace)

   Equipt (the “Marketplace”) is lead generation only. We do not process payments or facilitate the final transaction. Buyers are connected with Sellers who list Equipment; all negotiations and transactions occur directly between them.

   4.1 How We Use Marketplace Information

   1. Lead Generation

      1. Facilitate inquiries from Buyers to Sellers, allowing Buyers to request more details or quotes on Equipment.

   2. Communication

      1. Send relevant information to Buyers and Sellers regarding inquiries, lead follow-ups, and updates to listings.
      2. Contact you about your account, changes to our services, or other administrative matters.

   3. Improving the Marketplace

      1. Monitor, analyze, and improve user experience and the effectiveness of listings.
      2. Conduct research and development to enhance the functionality of the Platform.

   4. Marketing & Promotional Activities

      1. With your consent or as permitted by law, we may send you marketing communications about Equipt and our partners.
      2. Buyers who submit information on a listing consent to receiving communications from both Equipt and the Seller associated with that listing.

   4.2 How We Share Marketplace Information

   1. With Sellers

      1. When a Buyer requests information on a particular listing, we share the Buyer’s contact details (e.g., name, email, phone number) with the Seller who posted that listing.

   2. Within Equipt

      1. Among our employees, affiliates, or subsidiaries who require such data to help provide marketplace services.

   3. Third-Party Service Providers

      1. Companies that assist with analytics, hosting, or marketing may receive data as needed to perform their functions on our behalf. They are only authorized to use your data for these specific tasks.

   4. Compliance and Legal

      1. In response to valid requests by government or public authorities, or if we believe disclosure is necessary to protect rights, safety, or property.

   5. Business Transfers

      1. If we undergo a merger, acquisition, or asset sale, your information may be transferred as part of that transaction.

   6. Consent

      1. We may share information in other ways if you provide explicit consent.

5. Equipt Pro (Software)

   Equipt Pro (the “Software”) is our SaaS platform designed for Sellers, Brokers, and OEMs to manage contacts, leads, quotes, email marketing, and website content. Sellers can also choose to push published listings to the Equipt Marketplace or third-party marketplaces.

   5.1 How We Use Equipt Pro Information

   1. CRM and Lead Management

      1. Provide Sellers with a secure, private CRM system to store leads, contacts, notes, quotes, and other sales or marketing data.
      2. Facilitate internal workflows, such as quoting, pipeline management, and email campaigns.

   2. Content Management and Website Integration

      1. Allow Sellers to update and manage content on their own website(s) via the Equipt Pro CMS features.
      2. Only information Sellers voluntarily publish will be publicly visible (e.g., pushing a listing to the Marketplace or a third-party site).

   3. Analytics and Performance

      1. Aggregate usage data within Equipt Pro to provide Sellers with insights on leads, conversions, and marketing campaigns (e.g., email open rates, inquiry volumes).

   4. Support and Administration

      1. We may access Seller data when providing technical support or troubleshooting issues with Equipt Pro.

   5.2 How We Share Equipt Pro Information

   1. Seller-Controlled Data

      1. CRM and lead data within Equipt Pro remain private to the Seller by default. Equipt does not share or sell this data.
      2. If a Seller chooses to publish a listing to the Equipt Marketplace or any third-party marketplace, that information is no longer private to the Equipt Pro environment.

   2. Third-Party Integrations

      1. Sellers may use integrations (e.g., email marketing providers, payment processors) which have their own privacy policies. You acknowledge it is your responsibility to review and comply with those policies.

   3. Within Equipt

      1. Employees or contractors may access Seller data to provide customer support, solve technical issues, or improve Equipt Pro features. Access is strictly limited to authorized personnel.

   4. Compliance and Legal

      1. We may disclose Seller data if required by law, court order, or to protect the rights, property, or safety of our company, affiliates, employees, or customers.

   5. Business Transfers

      1. In the event of a merger, acquisition, or asset sale, Equipt Pro data may be transferred as part of that transaction, subject to confidentiality obligations.

6. Cookies and Similar Technologies

   This Privacy Policy applies to information we collect: We use cookies, web beacons, and similar tracking technologies to collect information about your interactions with both the Equipt Marketplace and Equipt Pro. This may include:

   1. Session Cookies:Maintain login status.
   2. Analytics CookiesUnderstand usage patterns and compile aggregated data.
   3. Functionality Cookies:Remember preferences and improve user experience.

   You can set your browser to refuse cookies, but note that some features of the Platform may not function properly without them.

7. Data Retention

   We retain your Personal Information only as long as necessary to fulfill the purposes for which it was collected (see Sections 4 and 5), or as required by law. Retention periods may vary based on the type of data and legal requirements.

8. Security Measures

   We implement appropriate technical and organizational measures to protect your Personal Information against unauthorized access, loss, or misuse. However, no method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children’s Privacy

   The Platform is not intended for individuals under the age of 13. We do not knowingly collect Personal Information from children under 13. If you become aware that a child under 13 has provided us with Personal Information, please contact us so we can take steps to delete it.

10. Your California Privacy Rights

    If you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”) or other California privacy statutes, including:

    We do not sell your Personal Information in the traditional sense. If any data handling activities could be considered a “sale” under the CCPA, we will provide you a method to opt out. To exercise your rights, please contact us as outlined in Section 15.

11. Other U.S. State Privacy Laws

    Other states (e.g., Virginia, Colorado) have enacted privacy laws that provide similar rights. If you reside in a state with additional consumer privacy rights, you may contact us to inquire about exercising those rights.

12. International Users

    Our Platform is primarily directed to individuals located in the United States. If you access or use our services from outside the U.S., your data may be transferred to and stored on servers in the U.S. By using the Platform, you consent to the transfer, storage, and processing of your data in accordance with this Privacy Policy and U.S. laws.

13. Third-Party Links and Services

    The Platform may contain links to third-party websites or services not operated by us. We are not responsible for the privacy practices of these third parties. We recommend reviewing the privacy policies of those sites before providing any Personal Information.

    We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use of the Platform after any modifications indicates your acceptance of the updated Privacy Policy.
